Sundt Construction and the City of Denton are seeking bids for GMP-2 of the Pecan Creek Water Reclamation Plant Headworks and Expansion Project. The Project includes the expansion/replacement of the existing Pecan Creek Water Reclamation Plant by constructing a new headworks and lift station, EQ and peak storage ponds, BNR/MBR basins, blower building, thickening/dewatering building, digesters, heat exchanger building, UV disinfection structure, control operations building, and backup diesel generators with an associated medium voltage building. Additional scopes of work include installation of sewer interceptors, removal of stockpiled "overs" materials, installation of buried utilities, modifications to the existing chemical building, and other miscellaneous site improvements.
Bids are to contain all labor, supervision, materials, equipment, supplies, tools, and services associated with the following bid packages:
• Electrical
• Cast-in-Place Concrete
• Precast Concrete
• Pre-Engineered Metal Buildings (PEMBs)
• Structural Steel
• Misc. Metals
• Bridge Cranes
• Process Equipment Procurement
• Site Utilities (Balance)
• Scaffolding
Electronic Sealed Proposals are required and will be received by Sundt Construction, Inc. via www.BuildingConnected.com (electronically sealed submission) prior to 2:00 PM on March 17th, 2026. Any bids received after this date and time will be deemed non-responsive and will not be opened. Prospective subcontractors and suppliers may obtain copies of the GMP-2 drawings, specifications, and bidding documents by requesting access to the Building Connected or by looking the project up on CivCast. Sundt Construction will hold a pre-bid conference and site walk on February 25th, 2026, 9:30am, at 901 Texas St # A, Denton, TX 76209. This pre-bid conference is MANDATORY for bidders on the Electrical, Concrete, and Site Utilities bid packages. Attendance of the pre-bid conference is highly encouraged for other bidders but is not mandatory.
Any and all contracts awarded under this bid process are expected to be funded in part by financial assistance from the Texas Water Development Board (TWDB). Neither the U.S. EPA or the State of Texas, nor any of its departments, agencies, or employees, are or will be a party to this IFB, RFP, RFQ, or any resulting contract. All contracts are contingent upon release of funds from the TWDB.
Beginning with SRF Equivalency projects approved under the 2023 Intended Use Plan (IUP) or later - Any contract(s) awarded under this Invitation for Bids is/are subject to the Build America, Buy America (BABA) Act requirements of Section 70901 of P.L. 117-58 of the Bipartisan Infrastructure Law, 2021.
This project is subject to American Iron and Steel (AIS) Requirements. Any contract(s) awarded under this Invitation for Bids (under the 2022 IUP or earlier) is/are subject to the American Iron and Steel (AIS) requirements of Section 608 of the Federal Water Pollution Control Act (33 U.S.C §1388) for Clean Water State Revolving Fund projects or Public Law 114- 113, Consolidated Appropriations Act, 2016, or subsequent appropriations acts, for Drinking Water State Revolving Fund projects.
This contract is subject to the Texas Water Development Board (TWDB) and the Environmental Protection Agency's (EPA) State Revolving Fund (SRF) Procurement requirements, which includes and offers procurement opportunities to all businesses during solicitations. EPA rules require that applicants and prime contractors/consultants make a good faith effort to award a fair share of contracts, subcontracts, and procurements in a nondiscriminatory manner through demonstration of the six affirmative steps. Davis-Bacon prevailing wage requirements apply to all construction, alteration, and repair of treatment works carried out, in whole or in part, with assistance made available by the Clean Water State Revolving Fund Program (CSWRF). For additional information on Davis-Bacon Wage Rate Requirements and its applicability to this contract, please consult TWDB Guidance No. DB-0156.
The John S. McCain National Defense Authorization Act for Fiscal Year 2019 (P.L. 115-232), at Section 889, prohibits EPA financial assistance recipients, including WIFIA borrowers, from expending loan funds to procure or obtain; extend or renew a contract to procure or obtain; or enter into a contract (or extend or renew a contract) to procure or obtain equipment, services, or systems that use covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. As described in the Act, "covered telecommunications equipment or services" means:
· Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities).
· For the purpose of public safety, security of government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities).
· Telecommunications or video surveillance services provided by such entities or using such equipment.
· Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of the National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.
The Act does not prohibit:
· Procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements.
· Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise.
This contract is subject to the federal requirements of Subpart C of 2 CFR Part 180 and Part 1532 regarding Debarment and Suspension. Bidder shall comply with the assurances provided with the bid that leads to a contract.
Recipients of federal grants, cooperative agreements, contracts, and loans are prohibited by 31 U.S.C. § 1352 from using federal funds to pay any person for influencing or attempting to influence any officer or employee of an agency, a member of Congress, an officer or employee of Congress, or an employee of a member of Congress with respect to the award, continuation, renewal, amendment, or modification of any of these instruments. This requirement also applies to the WIFIA program, which follows the EPA implementing regulations on lobbying restrictions prescribed at 40 CFR part 34.
WIFIA borrowers are required to certify that (1) they have not made, and will not make, such a prohibited payment, (2) they will be responsible for reporting the use of non-federal funds for such purposes, and (3) they will include these requirements in subsequent contracts and subcontracts that exceed $100,000 and obtain necessary certifications from those entities. See Exhibits T and U for more information.
Three important laws prohibit discrimination in the provision of the services or benefits, on the basis of race, color, national origin, sex, handicap or age, in programs or activities receiving federal financial assistance. These laws are:
· Title VI of the Civil Rights Act of 1964 (pdf), 42 U.S.C. § 2000d et seq., as amended, states that "No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance."
· Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. § 794 et seq., as amended and supplemented by Executive Orders 11914 and 11250, states that "(n)o otherwise qualified individual with a disability in the United States…shall, solely by reason of his or her disability, be excluded from participation in, be denied the benefits of, or be subject to discrimination under any program or activity receiving federal financial assistance…," and
· The Age Discrimination Act of 1975 (pdf) (135 KB), 42 U.S.C. § 6101 et seq., as amended, states that "(n)o person in the United States shall, on the basis of age, be excluded from participation in, be denied the benefits of, or be subject to discrimination under any program or activity receiving financial assistance…"
Borrower compliance with these laws is not limited to the project funded by the WIFIA program. These laws apply to the WIFIA borrower and its operations in its entirety. EPA's implementing regulations for programs and activities receiving federal assistance are covered under 40 CFR Part 7
