California DGS issues notice of proposed SBE/DVBE rulemaking

The California Department of General Services (DGS) has issued a notice of proposed rulemaking concerning regulations affecting the Small Business and Disabled Veteran Business Enterprise (SBE and DVBE) programs.

The new rules that are being proposed incorporate a wide variety of small changes to the legislation describing the programs, including but not limited to: tightening requirements on primes to fully comply with DVBE regulations; adding new verification requirements for DVBEs to which awards are made; ensure SBE and DVBE provisions are consistent with each other; requiring bidders to submit certificates attesting that a DVBE on a project is performing a commercially-useful function; and allowing state departments to set contract-specific SBE goals.

A 45-day public review period on the proposed rulemaking will begin on September 2, 2022, at 8:00 AM, and will close on October 17, 2022, at 11:59 PM.
