USDOT posts further clarifications on DBE eligibility

DC News - Published Oct 16, 2026

The United States Department of Transportation (USDOT) has released a list of answers to "frequently asked questions" (or FAQs) on the newly implemented Final Rule of eligibility for the Disadvantaged Business Enterprise (DBE) program.

The new rulemaking from USDOT, first issued in October 2025 and finalized in September 2026, eliminated race- and sex-based presumptions of social and economic disadvantage for purposes of eligibility for the DBE program, instead requiring applicants to provide a personal narrative of disadvantage. The rule further required all state DBE programs to go through a process of recertification before re-opening.

The FAQ document clarifies that applicants may describe instances of discrimination due to race or sex in their personal narratives when establishing their history of disadvantage, "provided that the claim of social and economic disadvantage is based strictly on the owner's individualized experiences and not on group-based presumptions." It also clarifies that a personal narrative does not need to include a full life story but can cover any relevant instances of disadvantage over the life of the applicant, and that an applicant does not need to provide corroborating evidence (such as evidence that a formal complaint relating to discrimination was made) of disadvantage, though such evidence can be included and may strengthen an application.
